Professional Quality

Frauke Niehues declares commitment to the professional provision of services in accordance with the qualitative standards of the profession.

Registration and Payment Agreement
Registration can be done by phone, letter, fax, email, web form or informally. Your data will be stored for internal purposes.
Receipt of the registration confirmation includes receipt of the invoice, which must be paid in accordance with the payment terms listed. Only payments received in due time are eligible for participation. Non-attendance or only temporary participation in an event does not entitle the participant to a discounted seminar price.

Cancellations
Cancellations by the participant/ purchaser must be carried out in written form. A processing fee of EUR 50.00 will be charged up to 28 days before the event begins. In case of later cancellation 75% of the event fees are charged. We would like to draw your attention to the possibility of seminar cancellation insurance.

In case of later cancellation 75% of the event fees are charged. In case other bookings cannot be cancelled (rooms, travel expenses, accommodation), these must also be paid. Contracts for company trainings with Frauke Niehues are binding. In the event of non-execution or premature termination, the full invoice amount is due. Of course you can transfer your registration to another employee of the company.

Individual appointments must be cancelled at least 72 working hours in advance by letter, fax, email or telephone. If cancellation is made later, a provision fee of 75% of the original fee will be charged, regardless of the reasons.

We reserve the right to cancel confirmed events for organizational or other important reasons (e.g. small number of participants) up to two weeks before the event. In this case, however, we will do our best to offer alternatives. If an event does not take place for these reasons, the prepaid fee will be refunded to the participant. Frauke Niehues is not liable for any further costs incurred in connection with a cancelled course. In the event of cancellation of the event - e.g. due to force majeure - no recourse claims can be brought against Frauke Niehues.

If Frauke Niehues is unable to provide services due to force majeure, illness, accident, or circumstances for which Frauke Niehues is responsible, Frauke Niehues is allowed to offer the services again one year. If this does not materialize, the participant is entitled to a full refund of the participation fee. There are no further claims.

Data Protection and Storage
With their registration, participants of training courses agree that their address may be passed on to other course participants of the same course (purpose: carpooling, exchange of information). If this is undesired, this must be communicated by written notice.

Frauke Niehues stores the client's data electronically within the framework of the Federal Data Protection Act to the extent necessary for business purposes. If the client does not want to appear as a reference for Frauke Niehues, he must communicate this in writing.

Copyright and Usage Rights
The client acknowledges the copyright of Frauke Niehues. This applies in particular to training and consulting documents, including any electronic media used or made available (audio or video carriers, files).

Usage rights of Frauke Niehues are only transferred to the client/participant within the scope of the agreed purpose. Any further exploitation (e.g. reproduction, distribution of texts and data, checklists, schedules, materials, etc.) is not covered by the contract and requires the written consent of Frauke Niehues. The course materials are intended exclusively for personal use.

Usage rights of Frauke Niehues are only transferred to the client/participant within the scope of the agreed purpose. Any further exploitation (e.g. reproduction, distribution of texts and data, checklists, schedules, materials, etc.) is not covered by the contract and requires the written consent of Frauke Niehues. The course materials are intended exclusively for personal use.

Copyright
We reserve all rights, including those of translation, reprinting and reproduction of the training documents or parts thereof. No part of the training documents may be reproduced in any form - even in part - without our written permission, not even for the purposes of classroom design, in particular processed using electronic systems, duplicated, distributed or used for public reproduction.

Registered Trademarks
We do not assume any guarantee that the mentioned products, processes and other names are free of third party industrial property rights.

Place of Jurisdiction
Place of Jurisdiction is Giessen, Germany. Exclusively the law of the Federal Republic of Germany applies.

Liability
Participation in the events is at your own risk. In the event of cancellation of a seminar due to illness, force majeure or other cancellations for which we are not responsible, there is no entitlement to the event being held. We assume no liability for objects being lost during training events or for other direct damages, costs including loss of earnings, loss of profit or claims of third parties, loss of data, travel expenses, accidents, consequential damages and financial losses of any kind.

If a client's system is used for practical exercises at company events, the client acknowledges that he alone is responsible for ensuring that all appropriate measures to protect his programs and systems against permanent loss are taken before the beginning of the training. The client further agrees that the contractor shall not be liable for any loss of programs or data on the client's computer systems occurring during or after the training.

Confidentiality
Frauke Niehues is obliged to maintain secrecy towards third parties with regard to all business and company secrets that have become known to them. This applies to all third parties that are not called upon to receive such information as a result of their official activities. This applies without time limit even after termination of the contract.

Final Provisions
For this contract and its execution the law of the Federal Republic of Germany applies exclusively. Participation conditions remain binding in their remaining parts even if individual provisions are legally ineffective. Ineffective conditions will be replaced by conditions that most closely approximate the economic purpose of the ineffective conditions. Any agreements deviating from this contract only become effective if agreed in writing.
